BIS Act 2016
The Bureau of Indian Standards Act 2016 — legislation governing BIS functions, certification, hallmarking, and non-compliance penalties.
The Bureau of Indian Standards Act, 2016 replaced the earlier BIS Act of 1986 and significantly expanded BIS's powers and scope. The Act establishes BIS as the national standards body of India, defines its functions (standards development, product certification, hallmarking), and sets out penalties for violations.
Key provisions: manufacturing or importing products in violation of a QCO carries fines up to ₹5 lakh (first offence) or ₹10 lakh (repeat) and up to 2 years imprisonment. Counterfeit BIS marks attract the same penalties. The Act also covers consumer rights to approach BIS for redressal.
BIS regulations and QCOs derive their authority from this Act. Understanding the Act helps manufacturers appreciate the legal seriousness of BIS certification compliance.
